Bond for a Naperville woman accused of stealing more than $50,000 from Waubonsie Valley High School has ben set at $30,000, according to the office of DuPage County State’s Attorney Robert Berlin,

A press release from the state’s attorney’s office said Kristy Davis, 48, appeared in Bond Court Sunday where Judge Robert Miller set bond at $30,000 with 10% to apply. She has been charged with one count of Theft over $10,000, a Class 1 Felony.

Davis was employed by Aramark and works as the Cafeteria Manager at the high school. As manager, Davis is responsible for making the daily deposits. Davis allegedly stole the cash before making the deposit. It is alleged that at times Davis also would steal cash and checks and then use the stolen checks on a subsequent deposit to make up for missing cash so that the deposit would appear accurate, the release said.

The alleged thefts occurred from October 3, 2013 through May 23, 2014. She was taken into custody without incident Friday by the Aurora Police Department, according to the release

“The very idea that someone would steal money from a school, particularly when schools across the state are facing serious funding challenges, is outrageous,” Berlin said in the release. “The allegations against Ms. Davis are very serious and will be met with the full force of the law. I would like to thank the authorities at Waubonsie Valley High School for their complete cooperation as well as the Aurora Police Department for uncovering Ms. Davis’ alleged scheme. I would also like to thank Assistant State’s Attorney Diane Michalak for her efforts in this case.”

Davis’ next court appearance is scheduled for December 28 for arraignment in front of Judge Robert Kleeman.

The complaint contains only charges and is not proof of the defendant’s guilt. A defendant is presumed innocent and is entitled to a fair trial in which it is the government’s burden to prove his or her guilt beyond a reasonable doubt, the release said.

Threat puts Metea Valley High School briefly on lockdown

AURORA – Metea Valley High School went on lockdown briefly Monday afternoon while police and school officials investigated the legitimacy of a bomb threat.

Aurora police spokesman Dan Ferrelli said about noon a student found a piece of paper in a bathroom with a note written on it. Although the information in the bomb threat was found not to be credible, police and school officials still conducted a search of the area as a precaution.

Ferrelli said the soft lockdown was lifted within a half hour.

A message from Principal Darrell Echols went out to parents of Metea Valley students about 12:20 p.m. about the threat.

“The Aurora Police determined there is no credible threat to our school and at no time were our students or staff in any danger. We will continue to make safety a high priority at Metea Valley High School,” Echols said in the message.

Ferrelli said police do not take any bomb threat lightly and will continue to work with school officials to find out who wrote the note.

He said depending on the severity of the incident, students involved in a potential threat could face misdemeanor or felony disorderly conduct charges.

On Oct. 30, all after-school activities at another Indian Prairie District 204 high school were cancelled as the result of a bomb threat. Neuqua Valley High School in Naperville cancelled a regional volleyball game and a symphony orchestra concert because of the threat. Police and school officials at Neuqua Valley searched the school twice Oct. 30 before the school opened under tighter security on Oct. 31.

Cathy Janek: Need for speed a problem on Naperville roads

$

In October, a teen was charged with speeding in excess of 35 mph over the speed limit after the driver was seen driving 106 mph near Bailey Road and Plainfield-Naperville Road in a 45 mph zone.

Unfortunately, the teen is not alone. Other motorists have been caught at excessive speeds on Naperville roads, including one who was clocked driving 124 mph.

Police report others have been caught along Route 59, including the construction zone. Others have used 75th Street as their personal drag race strip. Frequently, police say, alcohol is a factor.

During the last year, the Naperville Police Department also has investigated several serious accidents on Ogden Avenue and on Diehl Road where speed was a contributing factor, according to Naperville Police Sgt. Bill Davis.

Since the opening of the 95th Street extension a month ago, more than one resident has complained that it too has become a site for street racing.

The trend was noticeable enough that resident Jim Churchman spoke about it during a recent Naperville City Council meeting. On a typical Saturday afternoon, he said, it doesn’t take long for a street racer to appear.

Admittedly without a radar gun, Churchman estimated that speeds reach up to 100 mph as racers weave between traffic.

Churchman said cars line up, race across the bridge and race back while timing themselves. Churchman found that street racing occurs during two time periods — about 3:30 p.m., likely coinciding with school letting out, and later between 7:30 and 8:30 p.m.

In addition, Churchman said he has noticed many deer in the area. The combination of deer and street racers creates an undesirable mix, he added.

During the meeting, Naperville Police Chief Bob Marshall said his department is taking the issue “very seriously.”

The three local government bodies involved with the road, Naperville and Bolingbrook police, and the Will County Sheriff’s Department are working together on the issue.

The Naperville Police Department is in the process of conducting a speed study on 95th Street. Based on the results, further enforcement will be determined, Davis added. In the meantime, officers will continue to respond to and address traffic complaints and violations in that area as needed.

Under Illinois law, the penalty for street racing is strict. Any driver convicted of street racing will have their license revoked for at least 12 months.

For good reason, according to the Insurance Institute of Highway Safety, excessive speed is a factor in about a third of fatal crashes involving teens.

Rather than using public roadways, motorists who have the need for speed might want to drive the appropriate speed down to the Autobahn Country Club in Joliet.

Equipped with 3.5 miles of race track, the Autobahn Country Club operates two courses, reserving one for members and often renting the other to car organizations. Built similar to a golf club, it is geared for driving enthusiasts.

“Novices and beginners can learn how to drive on a track safely that is designed to go fast,” Autobahn’s founder and President Mark Basso said.

Tire walls, guard rails, and helmet usage make it a safe environment, he added.

“Even for those who can’t afford the membership, different organizations rent days so that the average person can receive instruction and exposure to driving on a race track.”

Commenting on how much has changed relating to cars and speed over the years, Basso said that cars are faster today than years ago, and traffic is much heavier.

Even a minivan today has more than 200 horsepower, Basso said.

“Back in the 1970s, Firebirds and Trans-Ams only had 180 horsepower,” he said. “There are outlets for people who have a need to go fast.”

But not on area streets.

Racetrack owner found liable on all counts in civil racketeering trial

Chicago — A federal jury on Monday found Illinois racetrack owner John Johnston liable on three counts in a civil racketeering case involving conduct engaged in by former Gov. Rod Blagojevich, and awarded $26.3 million in damages to four Illinois riverboat casinos including the Hollywood Casino Joliet and the Hollywood Casino Aurora.

Under the civil Racketeer Influenced and Corrupt Organizations Act (RICO) statute, these damages are trebled, making the recovery over $78 million to the casinos.

The amounts awarded represent roughly the 3 percent tax money charged on Illinois’ four Chicagoland riverboat casinos between 2008 and 2010 that went to Johnston’s two racetracks, Balmoral and Maywood.

Additionally, the jury awarded the riverboats $4 million in punitive damages for the civil conspiracy claim made against Johnston personally.  Each casino was awarded $1 million in punitive damages from Johnston.

“Mr. Johnston and Mr. Blagojevich conspired to subsidize Illinois’ racetracks on the backs of our shareholders,” commented Eric Schippers, Sr. Vice President of Public Affairs for Penn National Gaming. “Their actions at the time resulted in us having to reduce our workforce, cut back our marketing spend, and defer capital improvements. We are grateful to the jury for seeing through Mr. Johnston’s charade and for ordering him to return the money he and Gov. Blagojevich improperly took from us.”

Johnston defended claims under the civil RICO and state law claims, all of which arose out of alleged bribery of former Illinois Gov. Rod Blagojevich in 2008. At the time, Blagojevich, was independently under investigation for this same bribery scheme as well as selling Barack Obama’s senate seat. The bribery that was the subject of this case was also the subject of Blagojevich’s own conviction, for which he is currently serving a 14-year prison sentence.

After a grand jury investigation Tuesday, the owner of the Hollywood Palms movie theater was charged with more than 100 counts of felony tax evasion, fraud and failure to file tax returns, according to a press release from the Illinois Department of Revenue.

Edward Charles Bulthaup III was arrested Wednesday after Illinois Department of Revenue Criminal Investigations Division agents testified before a grand jury Tuesday.

“When a local businessman evades his responsibilities to pay taxes, it hurts the community, it hurts the state, and it causes every taxpayer to have to reach a little deeper to help pay the bills,” said Brian Hamer, director of revenue, in the release.

Agents searched two locations of his business in February: Hollywood Boulevard, DBA Hollywood Boulevard, 1001 E. 75th St., Woodridge; and Naperville Theater, DBA Hollywood Palms, 352 S. Route 59, Naperville. The Hollywood Boulevard location in Woodridge was purchased by Hobson Financial Group just days after the searches were completed. A Feb. 25 hearing gave final clearance for Hollywood Blvd. to be purchased by Hobson Financial Group of Illinois Inc., after a Jan. 31 public auction, court documents show.

The findings of the two searches were reported to the grand jury Tuesday. Records and computer information were seized, according the release. The Naperville Police Department also assisted. The investigations resulted in two separate multiple count indictments Tuesday.

The charges resulting from the searches at each theater, along with the minimum tax liability associated with each charge are as follows:

Hollywood Boulevard
1 count sales tax evasion — Class 1 Felony
6 counts sales tax evasion — Class 2 Felony
41 counts of fraudulent filing of Illinois sales and use tax returns — Class 3 felonies
1 count of mail fraud — Class 3 felony
1 count wire fraud — Class 3 felony
3 counts failure to file Illinois sales and use tax return — Class 3 felonies
(53 counts)

Hollywood Palms
1 count sales tax evasion — Class 1 Felony
8 counts sales tax evasion — Class 2 Felony
45 counts of Fraudulent Filing of Illinois Sales and Use tax returns — Class 3 felonies
1 count of Mail Fraud — Class 3 felony
1 count Wire Fraud — Class 3 felony

Naperville police are seeking more information after the arrest of Don A. Anderson, 67, of Naperville, who was charged with disorderly conduct.

A press release reported that Anderson was charged after a 23-year-old female alleged that he put a cell phone between her legs aimed up her skirt in an attempt to take a picture of her as she was bending over.

The incident allegedly took place Sept. 14 at Barnes & Noble Bookstore, 47 E. Chicago Ave., Suite 132, in downtown Naperville.

Other reports of similar incidents were reported in August at the Starbucks and Paper Source in downtown Naperville. Anderson was not charged in either of these incidents.
